— Як Ви оцінюєте важливість та необхідність ролі нотаріуса в правовій системі США?
— Роль нотаріуса у США — це передусім гарантія достовірності та юридичної сили документів. Нотаріус виступає не як адвокат, а як неупереджений свідок, що підтверджує справжність підпису, особу підписанта, а подекуди — і наміри сторін. Це надзвичайно важливо в умовах правової держави, де більшість зобов’язань оформлюється письмово.
— Які переваги може надавати онлайн-нотаріат порівняно з традиційним підходом у сфері юридичної документації?
— Онлайн-нотаріат (RON — Remote Online Notarization) дає змогу посвідчувати документи незалежно від місця перебування. Це особливо актуально для українців за кордоном або осіб, які тимчасово перебувають поза межами США. Онлайн-сесія проводиться в реальному часі з обов’язковою аудіо- та відеофіксацією, що забезпечує повний запис процесу та підвищує рівень безпеки.
— Як Ви радите клієнтам дбати про безпеку та конфіденційність при проведенні онлайн-операцій з документами?
— Я працюю через сертифіковані захищені платформи, що відповідають державним стандартам США. Рекомендую клієнтам користуватися виключно офіційними ліцензованими сервісами, уникати підключення до відкритих Wi-Fi мереж, не передавати персональні дані через месенджери та ретельно перевіряти посвідчення нотаріуса перед початком процедури.
— Які зміни в роботі нотаріуса в США Ви помітили внаслідок впровадження технологічних інновацій?
— Нотаріальна практика стала мобільнішою, гнучкішою та доступнішою. Клієнти можуть отримати послугу в будь-який час і з будь-якої точки світу. Зросли вимоги до нотаріуса у сфері захисту персональних даних, а також розширився перелік технічних знань, необхідних для якісного обслуговування.
— Як ставитеся до перспективи створення міжнародних стандартів у сфері онлайн-нотаріату для полегшення глобальних транзакцій?
— Це вимога часу. У сучасному світі, де угоди укладаються між сторонами з різних континентів, міжнародне визнання онлайн-нотаріату значно полегшило б юридичний обіг документів. Це питання потребує міждержавного діалогу та правової уніфікації, і я повністю підтримую такі ініціативи.
— Які специфічні труднощі виникають під час онлайн-нотаріальних сесій порівняно з традиційним форматом?
— Найпоширеніші проблеми пов’язані з технічними обмеженнями на боці клієнта: нестабільне інтернет-з’єднання, відсутність камери або мікрофона. Також трапляється нерозуміння процедури чи недовіра до дистанційного формату. Окремі труднощі виникають через відмову деяких іноземних установ визнавати онлайн-нотаріальні дії, навіть із апостилем. У таких ситуаціях важливо мати досвід і змогу супроводжувати, консультувати й захищати клієнта.

Nadiia HRYB is an experienced notary with 18 years of practice. Before the outbreak of full-scale war in Ukraine, she worked as a private notary in Kharkiv. She later moved to the state of Florida, where she now provides notarial services remotely via the Internet.
— How do you assess the importance and necessity of the notary’s role in the US legal system?
— The role of a notary in the United States is primarily to guarantee the authenticity and legal force of documents. A notary acts not as a lawyer, but as an impartial witness who confirms the authenticity of a signature, the identity of the signatory, and sometimes the intentions of the parties. This is extremely important in a state governed by the rule of law, where most obligations are executed in writing.
— What are the advantages of online notaries compared to the traditional approach to legal documentation?
— Remote Online Notarisation (RON) allows you to notarise documents regardless of your location. This is especially relevant for Ukrainians abroad or persons temporarily residing outside the United States. The online session is conducted in real time with mandatory audio and video recording, which provides a complete record of the process and increases the level of security.
— How do you advise clients to ensure security and confidentiality when conducting online document transactions?
— I work through certified secure platforms that meet US government standards. I recommend that clients use only officially licensed services, avoid connecting to open Wi-Fi networks, do not transmit personal data via messengers, and carefully check the notary’s certificate before starting the procedure.
— What changes have you noticed in the work of notaries in the United States as a result of technological innovations?
— Notary practice has become more mobile, flexible and accessible. Clients can receive services at any time and from anywhere in the world. The requirements for notaries in the field of personal data protection have increased, and the list of technical knowledge required for quality service has expanded.
— What is your view on the prospect of creating international standards in the field of online notarial services to facilitate global transactions?
— This is a demand of the times. In today’s world, where transactions are made between parties from different continents, international recognition of online notaries would greatly facilitate the legal circulation of documents. This issue requires intergovernmental dialogue and legal unification, and I fully support such initiatives.
— What specific difficulties arise during online notarial sessions compared to the traditional format?
— The most common problems are related to technical limitations on the client’s side: an unstable internet connection, lack of a camera or microphone. There is also a lack of understanding of the procedure or distrust of the remote format. Certain difficulties arise from the refusal of some foreign institutions to recognise online notarial acts, even with an apostille. In such situations, it is important to have the experience and ability to accompany, advise and protect the client.
